May the death penalty be applied in Texas, upon conviction and sentencing, if the manslaughter took place while conducting another felony?
She's accused of entering and being in the country illegally. Might accumulation of other convictions determine final sentence? Might other charges cause the manslaughter charge to be changed to murder?
I vaguely recall a reckless disregard manslaughter case by a sports celebrity some years back, I think in Fort Worth. The death was an accident, but the public called for severe penalty. The prosecutor kept finding more charges to pile on.
It is a custom, in some circumstances, to promote candidate Academy cadets to second lieutenant or ensign if they are killed before graduation. It may not apply here, but if it happened in this case, it might make a difference in sentencing.
